Bonsoir Inc. - Terms and Conditions
Welcome to Bonsoir Inc.


We are not a taxi service.
Customers are not permitted to ride in the driver's vehicle.
Bonsoir Inc. is a safe ride service that provides designated drivers for customers who are unable to drive their own vehicles. It is not a taxi service.
A team of two drivers is sent to a customer's location. One driver will drive the customer home in their own vehicle, and the second driver will follow to pick up their partner. 
Or one driver can drive the customer home and another driver will be waiting him at the customer's destination to get him back to his vehicle.
Customers are not permitted to ride in the driver's vehicle.
Services are available for both immediate and reserved rides through the Bonsoir Inc. mobile app.



Fees, Payment, and Cancellations

Pricing: The estimated price for a ride is available in the app before the service is confirmed. The charge is for a team of two drivers, and a base rate of $3.5 per kilometer is used. An additional $0.50 per minute may be added for long distances or heavy traffic. The minimum price for a 10 km ride is $40. Adding stops may also change the estimated price. An administration and insurance fee of $10 will always be applied.
Payment: The charge is made after the trip is completed. No refunds will be issued for completed trips unless there are exceptional circumstances.
Cancellations: A $20 cancellation fee will be charged if a ride is canceled or if the customer does not show up.
Fraud: All transactions on the mobile app are handled by a secure third-party provider. These providers have access to personal information to perform tasks on our behalf but are prohibited from using or disclosing it for other purposes. Precautions are taken to protect data from being inappropriately accessed, modified, or destroyed, though no security procedure is 100% safe. In the event of a security breach, all parties will be informed as soon as possible.



Responsibilities

Customer Conduct: Alcohol and/or drug consumption is not allowed in the vehicle during the ride. Drivers reserve the right to refuse service to any passenger whose behavior is a threat to the driver, the vehicle, or any other passenger.
Parking: If a driver is not comfortable with the destination's parking or driveway, they may ask that a vehicle is parked in a nearby location, which can then be moved the next day.
Customer Belongings: The customer is solely responsible for any personal belongings left in their vehicle.
Driver Status: Our drivers are independent contractors and partners, not employees of Bonsoir Inc. Bonsoir Inc. acts only as a facilitator connecting drivers and customers and is not responsible for any injuries, damages, or accidents that occur outside of a trip.



Limitations of Liability

Insurance: The price of the service includes a team of two drivers and insurance coverage. However, this insurance does not cover accidents, incidents, or minor collisions caused by the driver who follows in their own vehicle.
Vehicle Value: For vehicles valued over $50,000, it is the customer's responsibility to inform their insurer before using the Bonsoir Inc. platform to ensure adequate coverage. Bonsoir Inc. can only cover accidents for vehicles valued at less than $50,000 when caused by the designated driver.
Indemnification: By using the platform, the customer agrees to indemnify Bonsoir Inc. from any claims, damages, or losses that result from misconduct during a ride, violations of the terms and conditions, and any legal disputes with third parties.
App Usage: The download and use of the app are at the customer's discretion, and Bonsoir Inc. will not be held responsible for any consequences or technical problems that result from its use.



Complaints

All complaints or other necessary communications must be made within three business days following the events on which the request is based. Bonsoir Inc. reserves the right to reply or not to such a request, and a timely complaint does not mean that the company accepts or agrees with the content of the complaint.
If one of our drivers receives a speed camera ticket during a ride, it can be reported by contacting our support team through the help section of the app. A clear photo of the fine that includes the location, time, and amount must be provided.



Data Collection and Privacy

When a customer registers, they agree to receive emails and text messages for safe rides and account notifications.
Information Collected: When the app or website is used to create a profile or request a ride, personal information such as name, address, date of birth, and email address is collected. By providing this information, consent is assumed for the collection of data for that purpose only.
App Data: The app may also collect log data and information (through third-party products) regarding the device's IP address, name, operating system version, app configuration, time and date of service usage, and other statistics. Information related to geographical position may also be collected. With consent, exact location information may be collected using methods like GPS, wireless networks, and Wi-Fi access points.
Information Sharing: Personal information may be disclosed if required by law or if the Terms of Use are violated. Data is stored on a secure, firewall-protected server in our app database storage system.
Cookies: Cookies are used only for the purpose of navigating the app.



Miscellaneous

Identity Verification: Correct access information must be entered to verify identity. All electronic information sent to Bonsoir Inc. through the app is considered valid and authentic.
Terms Updates: Bonsoir Inc. reserves the right to update these terms at any time and will notify users of any significant changes.
Agreement: By pressing the button to agree, a signature on the terms and conditions is acknowledged.
